| AGREEMENT | 1) | PRIS agrees to provide services established and modified from time to time relating to an Internet connection ("the Connection") and related hardware and software (which services are called "the Services") to the User, and the User agrees to use the Services only in accordance with the terms and conditions of this Agreement. |
| NO LIABILITY FOR CONTENT | 2) | PRIS neither has nor exercises control over the content of information passing through the Connection, and make no warranties, express or implied, relating to the Services. Without limiting the generality of that exclusion, PRIS makes no warranty relating to the merchantability or fitness for any purpose of the Services, and makes no warranty or representation relating to protection of any kind, whatsoever that might be transmitted to or from, or stored by the User, in connection with the User's use of the Services (which information is referred to herein as "User Data"). |
| USE SUBJECT TO PRIS POLICIES | 3) | The User shall use the Services only in accordance with the terms and conditions of this Agreement, and in accordance with the PRIS Acceptable Use Policy as published on the Internet at http://www.pris.bc.ca/home/acceptableuse.html, and in accordance with any additions, amendments, or variations to such terms and conditions that may arise from time to time pursuant to this Agreement. The User shall not transmit any User Data in violation of any Canadian or other applicable legislation, and in particular shall not transmit any User Data contrary to any copyright laws, or contrary to any applicable laws relating to obscenity, or contrary to any international laws, agreements, or conventions relating to the restriction of exporting or disclosure of data to other countries. The User accepts the entire burden of ensuring that the User's use of the Services is in strict compliance with any and all such laws, agreements, and conventions. |
| ACCESS TO OTHER NETWORKS | 4) | The User may access other network services, including other Internet service providers, but in doing so shall comply with any and all rules and conditions that may apply to the use of such services. |
| TERMINATION OF AGREEMENT | 5) | PRIS may cancel this agreement on one month's notice to the User, except that PRIS may cancel the agreement without notice in cases where the User does not abide by the terms of the agreement. The User may terminate the agreement at the end of any calendar month by providing notice in writing or by email of the intention to cancel. Such notice must be received by PRIS by the 22nd day of that calendar month. A cancellation number, issued by PRIS, will be the only accepted proof of termination. |
| PAYMENT OF FEES | 6) | The User shall pay all fees, costs, and other charges incurred for the User's use of the Services, and for any access to the User's account with PRIS. All costs and charges invoiced to the User shall be due and payable upon receipt. Failure by the User to pay any such invoice within 15 days of receipt, shall entitle PRIS to treat the User as being in default. Any default by the User shall entitle PRIS to terminate the User's rights under this Agreement, without notice to the User, and without limiting other rights PRIS might have against the User. |
| INTEREST ON UNPAID ACCOUNTS | 7) | Outstanding unpaid accounts shall be subject to interest rate of 1.5% per month (18% per year) on the balance outstanding from time to time. |
| ENTIRE AGREEMENT | 8) | This Agreement contains the whole agreement between the parties hereto in respect of the subject matter hereof; there are no warranties, representations, terms, conditions, or collateral agreements, express, implied, or statutory, other than those expressly set forth herein, and in the Acceptable Use Policy referred to herein. |
| RIGHT TO CHANGE AGREEMENT | 9) | PRIS may change this Agreement from time to time as it reasonably sees fit, provided that any such change (whether by amendment, addition, or deletion of terms) shall take effect from and after 30 days following the delivery of notice of such changes to the User. Any such notice may be delivered by mail to the User's last known address, by personal delivery, by publication in a local newspaper, or by electronic transmission via the Service. |
| RIGHT TO CHANGE POLICY | 10) | PRIS may change the Acceptable Use Policy referred to herein, from time to time, as it reasonably sees fit, by publishing a revision on the Internet. In any case where a violation of this agreement has been deemed to occur with reference to the items covered by the Acceptable Use Policy, the User shall be informed of the current Policy, and shall be given an opportunity to conform to the Policy. Subsequent to such notification, continued use of PRIS services constitutes a full acceptance of the terms and conditions of the current Policy. |
| RELEASE FROM CLAIMS | 11) | The User hereby releases and forever discharges, and agrees to indemnify and hold harmless, PRIS, and its directors, officers, members, employees, and agents, of any and all claims, damages, suits, or actions arising against PRIS from the User's use of the Services. |
| ACKNOWLEDGEMENT | . | By using this service, the User agrees to be bound by the terms and conditions of this Agreement, and to abide by the Constitution and Bylaws of PRIS. |
